Sean "Diddy" Combs’ attempt to secure bail was stalled after a contentious two-hour hearing in New York on Friday, Nov. 21. The 55-year-old mogul, charged with sex trafficking and racketeering, appeared before federal Judge Arun Subramanian, who postponed making a decision on Combs' $50 million bail request.
Instead, the judge directed both the U.S. Attorney’s Office and Combs' defense team to provide more detailed information on how the accused has been communicating from behind bars during his two months of detention at the Metropolitan Detention Center in Brooklyn, as per a report by Deadline.
The deadline for submitting this information is set for 12 p.m. ET on November 25, with a ruling expected shortly thereafter, potentially before Thanksgiving.
Focus on Communication from Jail
At the heart of the delay is the judge's request for clarification on the forms of communication available to Combs while incarcerated. Prosecutors have raised concerns that the rap mogul may have used prison resources to contact potential witnesses, further complicating his bail bid.
The defense team, however, insists that the government’s concerns are exaggerated, arguing that Combs has not tampered with evidence or attempted to intimidate witnesses.

Judge Subramanian has asked both sides to provide details on the scope of Combs’ communication options and whether these communications could impact his ability to defend himself publicly.
In a notable exchange, Combs’ attorney, Alexandra Shapiro, referenced a modified gag order imposed on former President Donald Trump during his New York criminal trial, highlighting that such an order allowed Trump to criticize the case against him freely.
The judge has asked the legal teams to specifically address how much leeway Combs should be granted in publicly defending himself while behind bars.
Security Concerns and Opposition to Bail
While the defense has proposed strict bail conditions, including a $50 million bond, 24/7 private security, and limits on external contacts, the prosecution remains firmly opposed to Combs' release.
Pretrial services officials, who evaluate the conditions under which bail may be granted, sided with the prosecutors and recommended against granting bail.
They expressed concern that Combs could continue to exert influence over potential witnesses, including victims of his alleged abuse.
The prosecution has repeatedly highlighted efforts by Combs to intimidate and “blackmail” potential witnesses. One of the central pieces of evidence presented by the government is a video of an alleged 2016 assault on Combs' former girlfriend, Cassie Ventura.
Prosecutors argue that the footage, which shows Combs attacking Ventura, is key evidence in the case and supports their claims of coercion and abuse.
Controversy Over Evidence and Legal Privilege
The defense has continued to challenge the validity of evidence obtained during a recent sweep of Combs’ jail cell. The defense contends that the materials seized—19 pages of notes—are privileged and related to Combs’ legal strategy for his upcoming trial.
They also argue that some of the footage presented by the prosecution, particularly the video of the incident with Ventura, was altered to distort the events.
In response, the prosecution insists that all materials were obtained through standard procedures and that nothing in the seized documents was privileged.
The defense has also requested that the case be dismissed, accusing the prosecution of manipulating evidence to prevent Combs from securing bail. They argue that the charges against Combs are based on a flawed and biased portrayal of events, exacerbated by media coverage.
Living Arrangements and Bail Package
To secure his release, Combs’ legal team has offered a comprehensive bail package, including a $50 million bond, ankle monitors, and private security surveillance.
Additionally, Combs has proposed that he be allowed to reside in one of his properties in New York or Miami, with strict supervision on his interactions. The defense contends that Combs is not a flight risk, as his passport has already been seized by authorities.
Despite the ongoing legal battles, Combs' defense maintains that the charges against him are unfounded and that his reputation has been severely damaged by the government's actions. With a trial set for May 5, 2024, Combs intends to face the charges in court and clear his name.
